Federal Court Orders Freedom of Kilmar Abrego Garcia from Immigration Detention

A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment is without legal authority.

"Since his return from wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.

The case stems from a erroneous removal to El Salvador in March, which US authorities later acknowledged was an mistake. Following his return to the United States to face human smuggling allegations, he was held in immigration custody.

In her order, the court pointed out that the government lacks a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

The legal proceedings involve conflicting claims. While the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this claim.
